Target role: Berlin-local compensation would have been €115K base + 22% employer side (sozialversicherungspflichtige Abgaben + pension + equipment) = €140K/yr fully loaded. Why the DACH LLM-engineer shortage looks the way it does in 2026

Bitkom's 2025 Personalbericht counted 149,000 open IT roles in Germany alone, projected to double by 2028. Senior AI engineering is the bleeding edge of that gap — Stepstone's 2026 DACH Tech Compass shows open senior-AI postings at roughly 4× the active senior-AI candidate pool inside Germany. Austria and Switzerland sit at the same ratio with smaller absolute numbers. The domestic graduate pipeline cannot close the gap this decade: Bundesagentur für Arbeit projects local AI-specialist supply growing at ~1,800/year against demand growing at ~6,500/year through 2028.

German labour law makes a wrong hire structurally expensive in a way the UK and US markets do not feel. A senior engineer past the six-month Probezeit gets Kündigungsschutz — terminating without cause becomes a multi-month negotiation with the Betriebsrat plus a severance package typically worth 0.5 to 1 month salary per year of tenure. That is the asymmetry that makes the typical DACH process slow and conservative. Scheinselbstständigkeit is the legal concern Berlin and Munich CTOs raise first. §7 SGB IV defines dependent employment by five tests: integration into the client's organisation, control over work pattern, exclusivity, lack of own business risk, and absence of substitution rights. A genuine CEE B2B contractor passes all five from the Deutsche Rentenversicherung's perspective: registered business in their home country (JDG / ФОП / PFA), multiple clients per year, own equipment, control over working pattern, and a clean cross-border contractual line that has nothing to do with your German payroll. For tighter compliance edges we default to Employer-of-Record in the engineer's home country, which removes the §7 SGB IV question entirely. AÜG (Arbeitnehmerüberlassungsgesetz) is the second concern. AÜG applies when a German entity leases staff to another German entity. Cross-border B2B from a foreign sole-proprietorship to a German GmbH does not meet the leasing definition, and EOR employment in the home country is straight Dienstvertrag, not staff-leasing. We have onboarded engineers under both shapes for DACH clients in 2025–2026 with zero AÜG triggers from any DRV or Finanzamt review.

The role-specific angle: DACH LLM engineers must clear a higher engineering rigour bar than the equivalent US hire. Buyers want production miles, written ADRs, evidence of cost/latency calls in real workloads, and explicit reasoning about the EU AI Act implications of any LLM feature.
