What DACH scale-ups actually ask us.

How does Recruo handle Scheinselbstständigkeit risk for German companies?+

Two safe paths. (1) Pure B2B: the engineer operates a registered foreign business (JDG in Poland, PFA in Romania, ФОП in Ukraine) with multiple clients and invoices your German company cross-border. §7 SGB IV dependent-employment criteria don't apply to foreign businesses. (2) EOR (Remote, Deel, Oyster) — the engineer is formally employed in their home country with a real Arbeitsvertrag. DRV and German tax office have zero jurisdiction. We recommend the path based on your specific role structure.

What about AÜG (Arbeitnehmerüberlassungsgesetz) / labour-leasing licences?+

AÜG applies when a German-based entity "leases" staff to another German-based entity. Our model doesn't trigger it: we don't employ engineers in Germany, we don't lease staff to you, and our cross-border recruitment service is governed by regular Dienstvertrag rules. You pay for a successful placement; the engineer then contracts with you directly (B2B) or through an EOR in their home country.

Is your process DSGVO / UK GDPR compliant?+

DSGVO-compliant by design. We process candidate data under Art. 6(1)(b) (pre-contractual measures) and Art. 6(1)(f) (legitimate interest), with candidate consent flows documented. Data stored in EU regions (Frankfurt, Dublin). DPA signed with every engagement. 12-month retention on rejected candidates, immediate deletion on request. How does EU AI Act readiness specifically help our hiring compliance?+

Our flow already meets the 10 core Annex III obligations: human-in-the-loop (§14), audit trails (§12), bias testing, candidate notification, right to human review. When high-risk AI obligations kick in December 2027 (delayed from August 2026 via AI Act Omnibus), you won't need to re-audit or re-document anything — our per-engagement compliance checklist is your paper trail.

What are the VAT (Umsatzsteuer) implications for cross-border B2B?+

Standard intra-EU / third-country B2B: Reverse-charge applies. Your German GmbH receives a CEE contractor invoice with no VAT; you account for German Umsatzsteuer yourself and deduct it as Vorsteuer. Net VAT impact: zero. For services from Ukraine (non-EU), similar treatment under §13b UStG — your Steuerberater will handle routinely.

Do you have DACH clients?+

What about Betriebsrat involvement and co-determination?+

For full employment via EOR, the engineer is employed in their home country — your German Betriebsrat has no co-determination rights over foreign employees. For B2B contractors, no employment relationship exists, so co-determination doesn't apply. If you want to integrate CEE engineers into your German Arbeitsgemeinschaft (rare), we'll structure the engagement accordingly.
